Case No. 3097 has to do with an appeal from an ejectment suit which was dismissed in district court on a motion for summary judgment. The suit was brought by John J. Spriggs, Sr., and relates to certain mining property in Fremont County. The basis for dismissal was res judicata. The motion for dismissal set forth several suits which had been resolved against Spriggs and his predecessors in title involving the same property.
